Terms of Service

By accessing or using the PopKind platform (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms apply to all visitors, customers, fundraiser organizers, and participants.

PopKind Technologies LP (“PopKind,” “we,” “us,” or “our”) operates an online popcorn fundraising platform that enables schools, sports teams, clubs, and other organizations to raise funds by selling gourmet popcorn to supporters. We are registered in the State of Georgia.

To organize a fundraiser or access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at popkindsupport@gmail.com if you suspect unauthorized access.

You must be at least 18 years old to create an account. Individuals under 18 may participate in a fundraiser only under the supervision of a parent, guardian, or sponsoring organization.

Fundraiser organizers (“Organizers”) create campaigns through which supporters (“Participants”) purchase popcorn. A portion of each sale is returned to the Organizer’s group as fundraising revenue (“Profit Share”). The applicable Profit Share percentage is displayed at the time of campaign creation and may vary by product and plan.

PopKind reserves the right to refuse, suspend, or terminate any fundraising campaign that violates these Terms, applicable law, or our community standards.

All purchases are processed through our third-party payment processor (Stripe). By placing an order you authorize the charge to your selected payment method. Prices are displayed in US dollars and include applicable taxes where required by law.

Orders are subject to product availability. We reserve the right to cancel any order and issue a full refund if a product becomes unavailable after purchase.

We ship within the contiguous United States. Estimated delivery timelines are provided at checkout and are not guaranteed. PopKind is not responsible for carrier delays, incorrect addresses provided by the customer, or delivery failures outside our control. Risk of loss passes to you upon delivery to the carrier.

Shipping charges are calculated at checkout based on weight, dimensions, and destination. You will receive a tracking number by email once your order ships.

Due to the perishable nature of our food products, all sales are final once an order has been fulfilled and shipped. If your order arrives damaged, spoiled, or incorrect, contact us within 7 days of delivery at popkindsupport@gmail.com with photos and your order number. We will replace the affected items or issue a store credit at our discretion.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Submit false, misleading, or fraudulent information.
• Impersonate any person or entity or misrepresent your affiliation.
• Attempt to gain unauthorized access to any portion of the Service.
• Interfere with the proper operation of the Service or its infrastructure.
• Use automated bots or scrapers to access the Service without our written consent.
• Engage in any conduct that could harm PopKind, its users, or third parties.

All content on the Service — including logos, product images, copy, and software — is owned by or licensed to PopKind Technologies LP and is protected by United States copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

The Service integrates with third-party providers including Stripe (payments), Shippo (shipping), Supabase (data), and others. Your use of those services is also subject to their respective terms and privacy policies. PopKind is not responsible for the practices of any third-party service.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POPKIND TECHNOLOGIES LP AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO POPKIND IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100 USD.

You agree to indemnify and hold harmless PopKind Technologies LP and its affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Bulloch County, Georgia.

We may update these Terms at any time. We will notify you of material changes by updating the “Last updated” date above and, for registered users, by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
